Postal Service moves for summary judgment on issue of "comparability", arguing
that since GS-1811's do not receive FLSA overtime pay. Postal Inspectors should not receive FLSA
overtime pay.
April 15, 2010 –
Judge Selna orders Postal Service to provide all names and addresses of Postal
Inspectors eligible to join suit.
March 19, 2010 –
Court grants plaintiffs’ motion to re-open Consent to Join period.
February 2, 2010
– Plaintiffs move to re-open the Consent to Join period to allow new Inspectors
to join the lawsuit.
August 3, 2009 –

April 14, 2009 - Notice of reassignment of case upon receipt of mandate from the Ninth Circuit Court of Appeals. Case reassigned to Judge James V. Selma.
February 4, 2009 – United States Court of Appeals for the Ninth Circuit filed its Order and Opinion. The petition for panel rehearing was granted in part. The Opinion filed August 27, 2007 was withdrawn. The new Opinion remanded the case to District Court for a determination of whether there are executive branch employees who perform work comparable to the Postal Inspectors and are paid FLSA overtime, and whether the Inspectors are entitled to FLSA overtime or whether they are exempt. August 15, 2008 – Postal Inspectors filed their opposition to the Postal Service’s petition for rehearing in the Ninth Circuit.
July 17, 2008 – Postal Service filed its petition for panel rehearing of the Court’s August 27, 2008 decision to reverse the judgment of the United States District Court for the Central District of California.

May 12, 2004 The District Court granted plaintiffs' motion to certify this action as a class action and authorized plaintiffs to send notice to all postal inspectors. The Court also denies defendant's motion to transfer the case to the Court of Federal Claims. View a copy of the Order.

April 26, 2004 Defendant filed cross-motion to transfer action to Court of Claims in Washington, D. C.
